(4) The contract language is exclusively German.

(5) You may view, save, and print the currently valid General Terms and Conditions on our website.

§ 2 Conclusion of the Contract

(1) The presentation of products in the online store does not constitute a binding offer, but rather a non-binding invitation to order products.

(2) By clicking the “Place Order with Obligation to Pay” button, you are submitting a binding offer to purchase (§ 145 BGB).

(3) Upon receipt of your purchase offer, you will receive an automatically generated email confirming receipt of your order (confirmation of receipt). This confirmation of receipt does not yet constitute acceptance of your purchase offer; a contract is not yet formed by this.

(4) A sales contract is not formed until we expressly declare our acceptance of the purchase offer or ship the goods to you without a prior express declaration of acceptance.

§ 3 Prices

The prices listed on the product pages include the statutory value-added tax. Any shipping costs are itemized separately in accordance with § 4 and displayed before the order is completed.

The legal basis is Article 6(1)(f) of the GDPR (legitimate interest in stable, secure operation). A data processing agreement with netcup is in place pursuant to Article 28 of the GDPR.

(2) For deliveries to countries outside the European Union, additional customs duties, import sales tax, and clearance fees may apply; these are to be borne by the recipient and are not included in the stated shipping price.

(3) If you select cash on delivery as the payment method, the delivery company will charge an additional handling fee of €2.00. This fee is exempt from sales tax and must be paid directly to the delivery person.

§ 5 Terms of Payment; Default

(1) Payment may be made by bank transfer/advance payment, SEPA direct debit, or credit card. SEPA direct debit and credit card payments are processed through our payment service provider, Mollie.

(2) If you choose to pay in advance, we will provide you with our bank account information in the order confirmation. The invoice amount must be transferred to our account within 10 days.

(3) For credit card payments, the purchase price is authorized at the time of order placement. Your credit card account will be charged when we ship the merchandise.

(4) If you pay by SEPA direct debit, you are responsible for any costs incurred as a result of a chargeback due to insufficient funds in your account or due to incorrect information provided by you.

(5) If you are in default of payment, you are obligated to pay the statutory late payment interest.

§ 6 Delivery; Retention of Title

(1) The goods remain our property until the purchase price has been paid in full.

(2) If you are a business owner as defined in § 14 of the German Civil Code (BGB), the following applies in addition:

– We reserve title to the goods until all claims arising from the ongoing business relationship have been settled in full.

– You may resell the goods in the ordinary course of business; you hereby assign to us, effective immediately, the resulting claims in the amount of the invoice total, which we accept.

– We will release the security to which we are entitled upon request, to the extent that its realizable value exceeds the claims to be secured by more than 10%.

§ 7 Right of Withdrawal for Consumers

Consumers have a statutory right of withdrawal. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their self-employed professional activity.

Right of Withdrawal

Right
of Withdrawal:
You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party designated by you (other than the carrier), took possession of the goods.

To exercise your right of withdrawal, you must notify us
at
Magnon.Global GmbH
, Monika-Karsch-Ring 19, D-86935 Rott
, Email: info@magnon.global · Phone: +49 179 4630768

by means of a clear statement (e.g., a letter sent by mail or an email) regarding your decision to withdraw from this contract. You may use the attached sample withdrawal form for this purpose, though this is not required.

To meet the withdrawal deadline, it is sufficient for you to send the notification of your exercise of the right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we must refund to you all payments we have received from you, including delivery costs (with the exception of any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery option we offer), without undue delay and no later than fourteen days from the day on which we receive notice of your cancellation of this contract. We will use the same payment method for this refund that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this refund.

We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever occurs first.

You must
return or hand over the goods to

Magnon.Global GmbH, Monika-Karsch-Ring 19, D-86935 Rott,
without delay and in any case no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you ship the goods before the fourteen-day period expires.

You are responsible for the direct costs of returning the goods.

You are only liable for any loss in value of the goods if this loss in value is attributable to handling of the goods that goes beyond what is necessary to assess their nature, characteristics, and functionality.

§ 8 Exclusion and Premature Termination of the Right of Withdrawal; Return of Goods

(1) The right of withdrawal does not apply or expires prematurely for contracts specified by law, in particular for sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

(2) Please avoid damage and contamination. If possible, return the goods to us in their original packaging with all accessories. This request is not a prerequisite for the effective exercise of the right of withdrawal.

In doing so, a connection may be established to your Meta account, provided you are logged in there. The legal basis is Art. 6(1)(a) of the GDPR (consent). Data may be transferred to Meta Platforms, Inc. in the United States, secured by standard contractual clauses and the EU-U.S. Data Privacy Framework. For part of the processing, we and Meta are joint controllers pursuant to Article 26 of the GDPR; in this respect, Meta’s joint controller agreement applies.

§ 9 Damage During Shipping

(1) If goods are delivered with obvious damage caused during shipping, please file a claim with the delivery company as soon as possible and contact us immediately.

(2) Failure to file a complaint has no effect on your statutory warranty rights, but it helps us assert our own claims against the shipping company.

§ 10 Warranty

(1) The statutory warranty provisions apply. For consumers, the statute of limitations for warranty claims regarding new goods is two years from the date of delivery of the goods.

(2) Any warranty extending beyond the statutory warranty applies only to the extent that it is expressly stated in the order confirmation or in the product documentation.

§ 11 Discount Codes

(1) Discount codes issued as part of a referral from a Neuro-Spa Group center provide a 5% discount on the purchase price of the ordered merchandise.

(2) Only one discount code may be redeemed per order. Combining multiple codes or using them in conjunction with other promotions is not permitted. The discount value cannot be paid out in cash, nor can it be applied retroactively to orders that have already been completed.

(3) Discount codes are non-transferable and can only be redeemed within their validity period.

§ 12 Liability

(1) We bear unlimited liability for willful misconduct and gross negligence, as well as in accordance with the Product Liability Act. We are also liable for injury to life, body, or health in cases of simple negligence.

(2) In cases of simple negligence, we are otherwise liable only for a breach of a material contractual obligation (cardinal obligation) whose fulfillment is essential for the proper performance of the contract and on whose observance you may reasonably rely. In this case, liability is limited to foreseeable damages typical for this type of contract. This limitation also applies in favor of our vicarious agents.

§ 13 Information on the Disposal of Batteries, Rechargeable Batteries, and Electrical and Electronic Equipment

(1) Batteries and rechargeable batteries must not be disposed of with household waste. You are legally required to return used batteries and rechargeable batteries; you can drop them off free of charge at municipal collection points or anywhere batteries are sold. Batteries containing hazardous substances are marked with a crossed-out trash can and the chemical symbol of the relevant heavy metal (Pb: lead, Cd: cadmium, Hg: mercury).

(2) Electrical and electronic equipment must not be disposed of with household waste. You can return your old devices free of charge to a municipal collection point.

§ 14 Consumer Dispute Resolution

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 15 Final Provisions

(1) Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.

(2) Contracts between us and you are governed exclusively by German law, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).

(3) If you are a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from or in connection with the contractual relationship is our place of business.
